Out of court settlement reached in Tuck lawsuit;

A $300,000 settlement out-of-court was reached last Thursday, December 11 relating to a negligence lawsuit filed against the city of Red Boiling Springs in 2007.

The lawsuit had been brought against the city and RBS Police Chief Terry Tuck by Tuck's former sister-in-law Heather Tuck and David Alan Carter. Ms. Tuck and Carter were allegedly attacked in July 2007 by Tommy Tuck, causing them severe bodily injury.

The suit alleges that Chief Tuck failed to enforce an order of protection which Ms. Tuck had filed against her former husband, and that subsequent actions by Tommy Tuck could have been avoided had Chief Tuck arrested his brother for violation of the order of protection.

A mediator in the lawsuit recommended the recent settlement which the city's insurance provider will pay.

RBS Police Chief Terry Tuck and Tommy Tuck are brothers. Tommy Tuck was indicted on charges of attempted murder in connection with the alleged attack and is currently lodged in the Macon County Jail.

Several calls to the attorney representing the city asking for comment were not returned.

“I hate what my brother did,” said Chief Tuck, shortly after the settlement, “but, you know, I wasn't even on duty that day.”

After heated words were exchanged during the council meeting, council members voted unanimously not to discuss the situation again.
