The lawsuit, naming Joe Ferguson, individually and in his official capacity as Sheriff of Macon County, Tennessee, and Macon County, Tennessee, was dismissed Wednesday, February 11.
According to a story that originally ran in the Macon County Times in October of 2003, Robert E. Bergdorff, an inmate, claimed he was prevented from receiving necessary medical treatment while in custody. His attorney claimed he filed suit to get the surgery he needed, a hernia operation.
According to Sheriff Ferguson, Bergdorff was given two opportunities to have the surgery while incarcerated.
A medical furlough was granted to him from November 22, to December 13, 2002. According to Bergdorff, he was unsuccessful due to his not being able to enroll in TennCare.
In December he was granted another medical release to seek treatment from November 22, to January 10, 2003. Instead of seeking treatment he went AWOL. In July of 2003, Bergdorff was again arrested and brought back to the Macon County Jail.
Bergdorff currently remains at the Macon County Jail on original charges of domestic violence.
