Attempted copper theft from local business

Two individuals attempted to steal copper wiring from Ace Hardware in Lafayette on Thursday, May 16, according to police reports.

Ptlm. Derrick Gann of the Lafayette Police Department received a call Thursday stating that two individuals were behind Ace Hardware attempting to steal items from the property. Upon arrival at the scene Gann observed a blue van attempting to leave. He blocked the vehicle and spoke with two men, Michael Posey and Terry Bennett. There was a strong order of alcohol in the vehicle and on each subject according to Gann, and he observed several open beer bottles and cans and three rolls of copper wire in the back of the van.

After running Mr. Posey’s driver’s license, they came back revoked and he could not provide a valid proof of insurance.

Upon arrival of the key holder to Ace, Gann learned that the wire did belong to the business. “We did observe where Mr. Posey and Mr. Bennet had gained entry to climbing over the fence. There was blood on the top of the fence, and both of them had bloody hands,” said Gann.

At that time, Gann performed several sobriety tests on Mr. Posey and found he had noticeable nystagmus in his eye and was very unsteady on his feet both during the one leg stand and the walk and turn. Mr. Posey stated that he could not do any more tests and that he was too intoxicated to be driving on the roadway, according to the police report. Mr. Burgett and Mr. Posey were then placed under arrest.

Terry Allen Burgett was arrested for one count of burglary, one count of public intoxication and theft of property. Court date July 10. Bond was set at $4,500.

Micheal Posey was arrested on may 16 for one count of driving on revoked license, one count of theft of property, burglary, and open container. Court date July 10. Bond $11,500
