Officer Woodard stopped Smitty after realizing that the tags on her 1990 Ford Thunderbird actually belonged to a 1995 Dodge.
According to Officer Woodard's report, he asked Smitty for her drivers license, registration, and proof of insurance. Smitty allegedly reported that she did not have insurance or her license. She did have the title of car which she presented to Officer Woodard. He then informed her of why he stopped her and she stated she did not have time to get her tags for this car. Officer Woodard then reportedly asked her why she did not have her license and she stated they had been revoked for DUI.
Officer Woodard checked her information and found that her license had been revoked for DUI 2nd in Sumner County in April of 2001. She was then placed under arrest for DOR 3rd offense, registration violation and financial responsibility.
Lafayette Police Officer Jason Roberts arrived on the scene to assist Officer Woodard.
The vehicle was then searched by Officer Roberts and Officer Woodard. Items found in the vehicle included a marijuana pipe with residue, four empty bags, a pill bottle with three separate wrapped packets of white powder. Several mixed pills were found under the white powder.
At this time, a passenger, Marsha Johnson, was placed in handcuffs and LPD Lt. Matt Looper was called to the scene.
Lt. Looper field tested the powder while Officer Roberts and Officer Woodard continued the investigation. A second pill bottle was found with a packet of white powder and several pills underneath. A small glass tube was found with a brown stain that was unidentifiable.
Lt. Looper advised that the powder tested positive for methamphetamine. The subject, when asked, then allegedly stated it was "meth."
Officer Roberts located some Allegra pills, a glass jar that had a baster tube and a cigar with a small amount of clear liquid in the jar. Two bags, containing a leafy substance believed to be marijuana were found between the driver seat and center console.
Another baster tube and two bottles of heat were reportedly found in the back seat with several more bottles of pills. A plastic bag was located in the trunk that contained Red Devil Lye, a wire strainer, coffee filters, rubber gloves, stir sticks, funnels, and lighters. A canister of R-134A refrigerate was also found.
Officer Woodard contacted LPD Captain Phil Russell and informed him of the need to contact the Drug Task Force.
Agents Clint Hestand and Carlo Sguanci were called to the scene and cleared the area.
Smitty and Johnson were transported to the Lafayette Police Station for questioning. Johnson was released with no charges.
Smitty was charged with possession of scheduled III, possession of scheduled II, possession of scheduled IV, simple possession, possession of drug paraphernalia, financial responsibility, and DOR 3rd offense. Her court date has been set for October 15 with bond set at $11,000.
