Lawsuit blames drunken fight on tavern
Macoupin County man claims patron battered him
SANFORD J. SCHMIDT The Telegraph
EDWARDSVILLE — A Macoupin County man has filed suit in circuit court, claiming the operators of a Godfrey Tavern allowed a patron to become drunk, which resulted in a severe beating.
Kerry W. Lahr named the Beer Barrel Pub, the operator of the tavern, Holger Happel and the individual who allegedly did the beating, Jody Dwiggins.
Lahr claims the tavern operators sold the liquor to Dwiggins, who became involved in a confrontation with Lahr on March 13.
The plaintiff claims he suffered extensive injuries to his head and face. He said in the complaint that he has suffered loss of earning capacity, experienced pain and suffering and has spent a large amounts of money for medical expenses.
The suit claims Happel and the others who operate the tavern allowed people known to be violent to remain in the tavern, failed to remove Dwiggins from the premises when it appeared a confrontation was about to happen, failed to remove Dwiggins from the premises, failed to call law enforcement and failed to come to the plaintiff’s aid.
Lahr is represented by Roy Dripps of Alton. The defendants could not be reached Tuesday for comment.
